Welcome to Gtaste app. This terms and conditions of usage in this platform (Android application) is to set regulations in your order of homemade food from this app, which is provided by Gtaste(GARGA M COMMERCE Pvt.Ltd). By purchasing food products from this app, you are indicating your acknowledgment and acceptance of these terms and conditions. User should understand that by ordering products via the app, User agrees to be bound by these application Terms. Please understand that if user refuse to accept these application Terms, user will not be able to order any products from our application. About Us Gtaste in Indiasolely owned and Managed GARGA M COMMERCE Pvt.Ltd Located at Kinfra Hi Tech park, HMT industrial Colony, Kochi, Kerala - 683503. We provide a platform for every user to available home-made food from a large number of home chefs listed on our application. Our chef partner is using another android application(Gpartner) for managing their products.

  1. Placing an Order

    Once user have selected the food item from app, user will have to submit the order. Please note it is important that user check the information entered is correct and for any errors if any. On receipt of the payment, GTASTE will begin processing the order and we will send notification by email and SMS that payment has been received and the order is being processed.

    Where any payment user make is not authorized, user will be returned to the previous page on the application and we shall not be obliged to provide the services. Please note that once user have made the order and payment has been authorized you will not be able to cancel your order nor will you be entitled to a refund.

    Please note that from time to time there may be delays with processing payments and transactions, on occasion this can take up to sixty (2 to 45) days to be deducted from your bank account.

  2. Payment and Listed Price

    Prices will be as listed on Gtaste application. These prices include VAT and included delivery costs & special packaging which will be added to the total amount due, wherever applicable. Payment for all orders must be by Wallets, credit, debit card or Net Banking as listed. Please note that from time to time there may be delays with processing payments and transactions, on occasion this can take up to sixty (2 to 45) days to be deducted from your bank account or credit card. Our Chef partners can manage their product price through the Gpartner application. Gpartner accept the setup/account creation fees by using the payment gateway integration on it.

  3. Cancellation

    There is no guarantee for food delivery at a particular time or time slot. In the event of customer cancelling the order or not accepting the order due to delay in food delivery, no refund will be processed by GTASTE.

    Due to unforeseen circumstances i.e. bad weather etc, if we are unable to deliver the food at your address, you will not be charged for the order.

  4. GTASTE Liability

    GTASTE, and any of our group companies and the officers, director, employees, or agents of any of them, exclude all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party (including any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, or loss or damages arising from or connected in any way to business interruption, loss of opportunity, loss of anticipated savings, wasted management or office time and whether in tort (including negligence), contract or otherwise, even if foreseeable) in connection with our services, this application or in connection with the use, in ability to use or the results of use of this application.

    User understand and acknowledge that (i)GTASTE does not warrant the suitability of the Licensed Application to transact business, or receive products or services from any Chef who uses the business interface of the Licensed Application; and (ii) the Application Provider will not be liable for breach of any understanding and agreement between you and the chef and will not be responsible for any service levels, guarantees, or quality promised by the chef in relation to any products or services procured from the chef. The Application Provider disclaims all liability in relation to any transaction, arrangement or contract entered into between you and the chef through the Licensed Application and will not be responsible for any breach of such contracts or to any claims for losses, costs, damages, expenses or other legal action arising out of such transaction, arrangement or contracts.

    Nothing in these application Terms excludes or limits our liability for death or personal injury arising from GTASTE's negligence, nor GTASTE's liability for fraudulent misrepresentation, nor any other liability which cannot be excluded or limited under applicable law. Nothing in these applicaton Terms affects your statutory rights.

  5. Law and Jurisdiction

    These application Terms shall be governed by and construed in accordance with Indian law. Disputes arising in connection with these application Terms (including non-contractual disputes) shall be subject to the exclusive jurisdiction of the courts of Kerala (India).

  6. Situations Not In Our Control

    We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by events outside our reasonable control (Force Majeure Event).

    A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:

    strikes, lock-outs or other industrial action;civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war; fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster; impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;impossibility of the use of public or private telecommunications networks; andthe acts, decrees, legislation, regulations or restrictions of any government.

    Our performance under any contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavors to bring the Force Majeure Event to a close or to find a solution by which our obligations under the contract may be performed despite the Force Majeure Event.

  7. The Agreement

    These terms and conditions and any document expressly referred to in them constitute the whole agreement between us and supersede all previous discussions, correspondence, negotiations, previous arrangement, understanding or agreement between us relating to the subject matter of any contract.

  8. Termination

    We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability. We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service. All provisions of the Terms which by their nature should survive terminationshall survive termination, including, without limitation, ownership provisions, warrantydisclaimers, indemnity and limitations of liability.
